Thanks to popular television shows and movies, most Americans are familiar with the Miranda Rights. The Miranda Rights are recited to an individual being arrested so the individual knows of their right to counsel and the fact that they are entitled to an attorney even if they cannot afford one. But the right to counsel is far more complex than these two simple statements. It is important to understand your rights so that you can protect them during a criminal investigation. Here are some of the most common questions our Ontario defense lawyers are asked about the right to counsel.
Where does the right to counsel come from?
The Constitution provides the right to counsel in the Sixth Amendment. For centuries, this only applied to criminal matters in the federal courts. It was only in 1963 that the Supreme Court extended the right to counsel to the state courts, as well. This same decision (Gideon v. Wainwright) also held that the right to counsel meant attorneys must be provided to criminal defendants who could not pay for them.
This case established the right to counsel during court proceedings. But what about the right to counsel during a criminal investigation? You have the right to assert your right to silence and refuse to answer officers’ questions until you have consulted with an attorney. This right is so important that the Supreme Court required every defendant to be advised of it before being subjected to questioning while in police custody. These are the famous Miranda Rights. By requiring police officers to advise suspects of these rights, the Supreme Court intended to protect suspects from accidentally incriminating themselves (in violation of their Fifth Amendment rights) or by speaking to police without getting legal advice (in violation of their Sixth Amendment rights).
Do I have the right to switch attorneys?
You have the right to hire the attorney of your choice. You may also choose to hire a different attorney if you choose to do so. If you cannot afford an attorney and ask the court to assign a public defender, you will likely not have a choice in who is assigned to your case. You may also be unable to switch to a different public defender if your assigned attorney does not have experience in your particular charges, which illustrates just one of the many reasons it is worth the money to hire your own defense lawyer.
