Penal Code section 17(b) gives several ways a qualifying California wobbler becomes a misdemeanor: the prosecutor may file it that way, a court may decide before trial, or a later judgment or probation order may change its status. A felony label on an early document does not answer what the final charge or conviction is. First confirm that the specific offense permits both felony and misdemeanor punishment.

Is the offense eligible for section 17(b)?

The threshold is in the statute’s opening language: it addresses a crime punishable, in the court’s discretion, by a felony prison or § 1170(h) term or by a fine or county-jail sentence. An offense that is a straight felony does not become reducible just because a defendant asks. For a charge citing another code, read that offense’s own punishment clause along with § 17.

The firm’s misdemeanor and felony guide explains the broader classification distinction.

The place where a sentence is served is also not a shortcut. Section 17(a) includes qualifying imprisonment under § 1170(h) in its felony definition, even though that term may be served in county jail. The judgment and statutory sentencing basis matter more than the word “jail” on a summary.

Which stage does the paperwork show?

The current § 17(b) text, amended by AB 321 effective January 1, 2026, identifies different routes. For the probation route, § 17(b)(3) says, in an exact short excerpt, “on application of the defendant or probation officer thereafter.” This is an excerpt, not the entire subdivision; the table below explains its timing alongside the other routes. They should not be collapsed into a promise of a later motion.

Stage What § 17(b) says
Filing Under (b)(4), a prosecutor can file a misdemeanor complaint in a court with misdemeanor jurisdiction. The provision also addresses a defendant’s objection at arraignment or plea, in which case the complaint is amended to charge the felony.
Before trial Under (b)(5)(A), the court may determine the offense is a misdemeanor on its own motion or a party’s motion. After denial of this type of motion, (b)(5)(B) requires changed circumstances for another such pretrial motion, including newly available facts or changed applicable law.
Judgment Under (b)(1), the offense is a misdemeanor for all purposes after judgment imposes punishment other than state-prison or § 1170(h) felony imprisonment. Read the actual judgment, not just the arrest charge.
Probation Under (b)(3), the court may declare the offense a misdemeanor when it grants probation or later on application of the defendant or probation officer. The declaration is a court act; probation by itself is not the same thing as proof that one occurred.

Section 17 also contains separate provisions for commitment to and discharge from a secure youth treatment facility. If that is the posture, the youth-specific language in § 17(b)(2) and (c) must be read rather than applying the adult probation row automatically.

What reduction does not decide

An unfulfilled restitution order or restitution fine cannot itself be grounds for denying a request or application for reduction under the current § 17(f). The rule addresses the reduction decision; it does not say the money owed disappears. Section 17(e) also says the court’s discretion here does not relieve a person of a sex-offender registration duty in the circumstances it describes. Neither point should be inferred from a shortened docket label.

A reduction is not the same as dismissal of a conviction under Penal Code § 1203.4, and it does not answer every federal, licensing or firearms question. Those consequences depend on other law and the exact record. Ask for the complaint, plea, minute order, probation order, judgment and any prior § 17(b) ruling before deciding what the court has already done or what request remains.
