If you are currently registered with a Fresno County law-enforcement agency, the Fresno court’s adult procedure uses Judicial Council form CR-415 with proof of current registration. The petition must be served, and the court must grant it before the California registration duty ends. Filing the form by itself does not stop registration.
Confirm the filing county and gather the records
Start with the agency where you currently register and the exact tier and registration dates shown in your records. Fresno County’s adult guide directs people registered with a Fresno agency to file the petition in Fresno. The statewide instructions address other situations, including registration in more than one county; check those instructions and the current statute before choosing a county if your registration situation is not the Fresno-only one described here. (Fresno County Superior Court criminal forms and information; CR-415-INFO; Penal Code § 290.5)
Gather proof of your current registration and records identifying your underlying case, registration tier, and the dates that may matter. CR-415 asks for registration and case information and calls for proof of current registration. It is a petition, not a certificate that a waiting period has been satisfied. Eligibility depends on the statute and the person’s record; time elapsed alone does not establish that the court can grant relief. (CR-415; Penal Code § 290.5)
File, serve, and document each step
Complete CR-415 and attach the required proof. Keep a copy of the filed version and any file-stamped receipt. Fresno’s posted adult guide describes serving the filed petition on the Fresno registering law-enforcement agency and Fresno District Attorney. It also directs service on the law-enforcement agency and prosecutor in the conviction county when those are different from the Fresno agencies. Confirm the right offices and service method for your case before sending anything. (Fresno County adult SB 384 guide; Penal Code § 290.5)
The Fresno guide directs service of the filed petition on the required agencies and filing of proof of that service within 15 court days after the petition is filed. The clock runs from filing the petition, not from serving it. The Judicial Council’s optional CR-416 can help record which agency or prosecutor was served, how, and when; file proof as directed. Because the Fresno guide predates the current statute, check its local instructions against current Penal Code § 290.5 and current court directions before relying on that timing. The statute and current Judicial Council forms control if they differ. (Fresno County adult SB 384 guide; CR-416; Penal Code § 290.5)
Track the court process and keep registering
After service, track the agency report and any notice from the District Attorney or court. The statute provides for agency review and a possible hearing before a petition is granted or denied. Do not treat a filed or served petition, the passage of a minimum period, or a pending hearing as termination. Continue to comply with the registration requirements unless and until the court grants the petition and an order ending the California duty is entered. A California order does not decide whether another jurisdiction requires registration. (Penal Code § 290.5; CR-415-INFO)
