Read your signed Kern Superior Court form CR-0314 and use its return date, marked conditions and named no-contact person to prepare. Before the first Domestic Violence Diversion Program (DVDP) hearing, the form directs participants to arrange the Family Justice Center fee through Financial Services or seek the court’s review of a fee waiver, and to bring proof of the arrangement or waiver recommendation. A blank form is a checklist of possibilities; your signed form and later court orders control what applies to you. (Kern Superior Court CR-0314)
Confirm the next hearing and the actual conditions
Copy the case number, assigned court division, hearing date and time from the completed CR-0314. Check whether the court has set any separate appointment or reporting instruction. Keep a copy of the signed form where you can find it before the hearing. The current Kern local-forms index lists CR-0314 as a mandatory local form, revised July 13, 2026; that listing does not itself mean every defendant qualifies for the program.
Read each marked box and handwritten term with counsel. The form includes a no-contact condition naming a specific person and options for classes, a 12-week education component, and other requirements that may be selected for the case. Do not assume an unmarked option was ordered or that a marked no-contact term ends while fees or program admission are being discussed. If another protective order also exists, ask counsel to compare the actual orders before any contact. (CR-0314)
Handle the fee step before the first hearing
CR-0314 calls for contact with Financial Services to make a payment arrangement for the Family Justice Center fee before the first DVDP hearing. If payment is not affordable, the form also describes court review of financial circumstances for a waiver recommendation. Bring documentation of the arrangement or the recommendation to that first hearing. Ask counsel or the court where and how to obtain the required proof if the process is unclear. The amount printed on a form is not a reason to assume waiver review is unavailable. (CR-0314)
At the hearing, be ready to identify which conditions have already been addressed and which remain scheduled. Keep receipts, class enrollment records and any later compliance documents. If a provider gives conflicting instructions, show counsel the signed order and ask the court to clarify; do not treat a provider’s statement as a change to the court’s order.
Ask what legal program the court is using
The Kern form calls its program DVDP and says successful completion may lead to dismissed charges. It does not, by itself, establish the legal basis, whether an admission or plea is involved, or the result in your case. Counsel should identify those points from the charging papers and court record before you agree to terms. (CR-0314)
This local DVDP should not be described as ordinary judicial misdemeanor diversion under Penal Code section 1001.95, which excludes charges involving domestic violence. A completed CR-0314 is therefore the practical starting point for preparing for the Kern hearing, while counsel checks the actual legal and charging posture.
