San Diego County’s form CRM-227 asks the receiving Adult Drug Court to consider an incoming participant’s suitability. It applies by its terms to someone in good standing on felony Drug Court probation in another county. Sending the form does not guarantee placement. A separate transfer of probation jurisdiction may also be required; CRM-227 does not replace that legal process or change the orders you currently must follow. (CRM-227; Penal Code § 1203.9.)

What the requesting county and participant provide

The form asks for the requesting court’s name and address, court and probation case numbers, felony charge, Drug Court contact information, and the requesting Drug Court judge’s signature. It also asks the participant to select a receiving San Diego division. Confirm the correct case identifiers and origin-court contact with the current Drug Court team before submitting the request. (CRM-227.)

The participant section asks for the new ZIP code and proof of the address change. Listed examples include a recent utility bill, lease or rental agreement, mortgage documents, or postmarked U.S. mail. It also asks for the participant’s employer and immediate supervisor with contact details, an intention to live in San Diego County for the Drug Court program’s duration, and a signature agreeing to follow the receiving program’s rules. Complete those fields only with accurate information and supporting documents. (CRM-227.)

Program review is not a guaranteed transfer

The form states that the receiving Drug Court makes a comprehensive suitability determination and that use of CRM-227 does not guarantee acceptance. The current San Diego criminal forms index still lists CRM-227, although the form is dated 2006; confirm the court’s current processing instructions. (San Diego criminal forms index; San Diego Drug Court information.)

Program placement and transfer of probation jurisdiction are separate decisions. If jurisdiction must transfer, section 1203.9 and the applicable court procedure govern that issue. Do not treat a CRM-227 submission or an informal program response as changing supervision, reporting, treatment, or other conditions. Wait for the required court action and updated instructions before changing what you do. (Penal Code § 1203.9.)
