SC-3085 is Santa Barbara’s mandatory misdemeanor plea form. Complete it only if you are choosing a guilty or no-contest plea. Initial a statement only if you understand it and it applies; leave an unclear or inapplicable item blank and ask counsel before signing. The form documents a plea, but the court must still review and accept it. (Santa Barbara form SC-3085.)

Check the plea terms and waivers

Compare the charge and maximum jail or fine listed on the first page with the actual charge and proposed agreement. Check the prior-conviction and probation-violation entries, then review the rights you would waive, the guilty or no-contest choice, and every promise or condition. The form’s consequences section includes categories such as immigration, firearm, and license effects; which ones apply depends on the case. Before signing, resolve any mismatch in charge, term, prior, or promised disposition with counsel. (SC-3085.)

A no-contest plea has the effect described in Penal Code section 1016, which differs for offenses punishable as felonies and other offenses. If you are not a United States citizen, section 1016.5 requires a specific immigration advisement on the record before a covered plea. The form’s printed language does not by itself establish that the required oral advisement occurred. Get case-specific immigration advice before entering the plea. (Penal Code § 1016; § 1016.5.)

Check any special sentencing term

For a domestic-violence probation case covered by Penal Code section 1203.097, the statute sets a minimum probation term of 36 months. SC-3085 offers 36- or 48-month choices; do not assume 48 months is required in every case. Review the actual proposed term and other applicable conditions. (Penal Code § 1203.097.)

The form also includes sentencing-delay, same-sentencing-officer, and commissioner waivers. Understand each one before initialing. At the plea hearing, the court must orally examine you before accepting the plea. Make sure the form matches the offer and that you understand the rights and consequences it records. Do not sign a blank, inaccurate, or unexplained term. (SC-3085.)
